FORMATION AND DEVELOPMENT OF PRIVATE LAW IN THE KYRGYZ REPUBLIC

Abstract

The article reveals the main milestones in the development of private law in Kyrgyzstan; a historical and legal analysis of its legal registration and implementation is carried out; the main features and characteristics are revealed; the main tasks at each historical stage of development are revealed. In particular, it is noted that in the pre-revolutionary period, the private law of Kyrgyzstan was essentially feudal law, regulating property relations in the interests of the dominance of secular and spiritual feudal lords; in the Soviet period - legal conditions were created for the development of cooperative ownership; civil law strengthened the protection and protection of the right of personal property of citizens and the collective farm yard; in the postSoviet period - equality, autonomy of will and property independence, inviolability of property, inadmissibility of arbitrary interference in private affairs are recognized at the constitutional level. It is proved that the uniqueness of the domestic legal framework lies in the legal tradition, which in different historical eras was quite unstable due to the strong influence of first nomadic, and then Russian legal tradition.
